Consent Statement for Data Processing and Cross-Border Transfers
I confirm that:
- I consent to the collection, processing, and storage of my personal data by Omnitalent for recruitment, placement, and employment purposes in compliance with POPIA.
- I consent to the sharing of my personal data with prospective employers and third-party service providers within South Africa and internationally, including but not limited to the UK and UAE.
- I understand my rights regarding my personal data and acknowledge that I may withdraw my consent at any time by contacting Omnitalent in writing.
Indemnity Agreement (For Global Contracting)
- Parties This Indemnity Agreement (“Agreement”) is entered into between Omnitalent (“the Company”) and the Candidate (“the Contractor”).
- Purpose The Contractor acknowledges that they may be placed on assignments outside South Africa, including in jurisdictions such as the UK and UAE, and agrees to indemnify Omnitalent against any legal, financial, or contractual liability arising from such assignments.
- Terms of Indemnity The Contractor:
- Agrees that Omnitalent acts solely as a recruitment and placement facilitator and does not assume responsibility for employment conditions or labor laws in the country of assignment.
- Indemnifies Omnitalent, its directors, employees, and agents against any claims, damages, legal costs, or liabilities arising from their engagement with an employer outside South Africa.
- Acknowledges that they are responsible for understanding and complying with all labor laws, tax obligations, and work permit requirements applicable in the country of assignment.
- Limitation of Liability Omnitalent shall not be held liable for:
- Any disputes between the Contractor and the employer.
- Any employment-related claims under foreign jurisdiction laws.
- Any damages or losses incurred by the Contractor while working abroad.
- Governing Law This Agreement shall be governed by the laws of South Africa, and where applicable, the laws of the UK and UAE. Any disputes arising from this Agreement shall be resolved through arbitration in South Africa unless otherwise required by foreign jurisdictions.
- Acknowledgment By signing this Agreement, the Contractor acknowledges that they have read and understood its terms and agree to be bound by them.
